Story about a profession horn guy suing a DNR agent. Has some interesting aspects regarding drone use and 4th Amendment issues.

Hunter Sues DNR Agent

Interesting link, thanks for sharing. Mark Luster was a part of the "Whitetail Group" I think they're called with the likes of Lee Lakosky and Bobby Kendall. Not sure if he is still apart of that crew after this or not.

I wish the DNR would drones more often to look for illegal baiting activity.
Not during prime time on November 5th !! I think drones can chase deer off the fields …

Midday maybe ?

So he’s mad he got caught baiting. Poacher.

In Iowa, isn't it legal to put minerals out before season? But, it has to be removed "x" number of days before season?

Isn't this situation similar to the Joe Franz buck?

Some drone cameras have so much magnification that they can fly high enough that they don't spook deer. There are some really cool drone deer recovery videos out there and it is pretty crazy how far they can zoom in.

The guy was obviously baiting and is trying for a technicality to save his “reputation”.

I'm more than a little surprised by seemingly everyone's willingness to allow Big Brother to break the 4th amendment in the name of catching poachers. Seems like a slippery slope for people who enjoy what few freedoms we truly have left in this country.

I didn't read the whole article yet. Just enough to see who the hunter was. Never quite thought he passed the sniff test.

I’m of the mindset that if you aren’t breaking the law they won’t waste much time on you. In this instance I care about the sanctity of the resource enough to concede the ends justify the means. If the game wardens want to fly my property (which is 100% legal apparently so I’m not even sure why this is debatable) they will be bored out of their minds after 10 minutes. I have zero to hide except my pecker when I have to take a leak.
Apparently I had a neighbor a while back that was poaching turkeys over bait. The warden was flying a drone to see if he was sitting on the pile. Phenomenal use of the resource over him walking in and sitting there for hours on end just waiting.

Until drones over private property are outlawed, I’m all for this. Even if they were ever outlawed (which they won’t be), I’m fine with law enforcement with probable cause. They have both hands and feet tied behind their backs as it is already.

I personally would be extremely pissed if a drone came over my farm without my permission.

What’s the law on rights above your land ?

Besides just the cheaters and poachers knowing the law could be watching from above would cause many of them to sustain from the activities. I have a feeling if a drone would fly over my neck of the woods more often then I would have a turkey roosting on me more often instead 5 roosting on my neighbors. They can fly of over my land daily as long as the also fly over my neighbors

I think there’s some misunderstanding on modern drone tech. I don’t need to fully directly over you to watch you. They can watch you from a 1/2 mile away and 800’ high. Spooking game or interfering in your hunt is literally a nonfactor

Aren't drones limited to 400' ? Or did that rule go away?

You may be right. I don’t own one but I know they can get high enough and far enough you won’t know. Additionally law enforcement may be able to break ceiling requirements the average user has

Not all true. 400' AGL is the limit. Police are held to the same standard.

Ok whatever I’m just illustrating that you don’t have to park 100’ above someone to observe. I’m not a drone pilot

Interesting the article said the idnr had proof he was baiting due to certain chemicals they found in the ground. I think that Iowa baiting law make things complicated especially if you use some sort of mineral block with food.
