Should have shot him. Sounds like you had the right considering he came to your house and threatened you while advancing.
I am glad I didn't. I have been struggling enough with the dog, which is more or less innocent.
And the dog lived, and I knew it would.

Make sure you have up all required signage for your state that makes it so you don't have to tell him to leave before he can be charged with trespass.Also get those cameras and I don't care if you throw a rock at his dog don't tell anyone.If still running loose catch in big box trap and take about 50 miles away to the humane society. Also check with the ag laws in your state which probably allows you to protect livestock
Ag laws only apply to working dogs working, same with hunting dogs. I am going to be curious to see if signage means anything when the intent is to do bodily harm?
I had to admit it, because it was pretty obvious, and that is another reason why it was justified and his reaction is the problem. I had no problem telling him his dog was running amuck. His response was to cause bodily harm.
Just to be a dick, I should pay the vet bill, then ask for it back as restitution.

I don't think the prosecutor would bother charging you with anything, based on the evidence you gave. I'm not familiar with your local laws, but there doesn't seem to be evidence you committed a crime.
The neighbor seems to have broken at least one law regarding menacing.
In the mean time, I would upgrade your security cameras as much as possible, including audio.

You had to pull a gun on the guy? That's worrisome. I'd be documenting everything and in contact with LEO's constantly.
I did, its not my first armed confrontation, but certainly the closest I have come to a discharge. Its bringing up more than legal issues for me.
This is literally city folk moving to a town of 500. What I did that precipitated this has been common practice for me (and probably you too) since a child, and happens to be codified in law. Control your god damned dogs.
Now they are trying to get a TPO against me, but it looks like I will be using against them. How the hell do you go to someone's home, threaten them, try to assault them in their own home, and then you get a TPO? Because your failure at dog ownership resulted in your dog getting shot with a pellet gun? WTF planet am I living on?
The only thing that I can possibly see is something under animal cruelty, which includes things like abandoning, neglect, etc. So......we can go there I guess.
I am leaning pretty heavily on 575.020, its been around a while in one form or another. I was actually trying to prevent the killing part, but I guess I made a mistake there.
What little footage I have shows the guys anger. The camera in the police car also caught his anger, some 20 minutes after I stopped him on my porch. I approached one of the deputies, got within 20' of the dickhead and he starts shouting "go ahead and pull your gun now!" repeatedly. I stepped in front of the camera and calmly said "if you try to assault me on my home again, I will."

Shoot the dog dead on second offense. If you love your dog, you'll keep him where he needs to be.
Shooting a human is a tough pill to swallow. You gotta be ready to handle that mentally, justified or not. I won't look down on you if he threatens you, but you gotta fall asleep at night with that image in your head. That's a tough one.

It's the owner who is responsible for keeping their "pets" under control. The guy sounds like someone who will give it some time and then do something to you in the future in my opinion. Also sounds like the typical idiot from a metro area that thinks they are "special". I have a strong dislike for people that are only looking to make more trouble instead of "owning" anything that they are responsible for. I have had similar issues with my one neighbor who was/is an actual druggy. Even the guys "old lady" carried about a 12" buck knife on her side. Thank god they eventually moved away or who knows how far the bullshit would have went with them. Dogs are just being dogs 99% of the time and it's the owner who needs to do the right thing and keep their dogs under control. I don't think this will just end very well in your situation. I would have my head on a swivel from now on if it were me. jmho

Hopefully the law enforcement you are dealing with will actually do their jobs and aren't buddies with this guy where they will let him skate instead of enforcing the laws. Where I'm at the cops are NOT doing their jobs and all of the criminals are known to the community with nothing ever happening to the thieves/druggies/dirtbags. Good Luck sir.
Agree with everyone. Don't be a victim, stand your ground, don't put up with shit. These type of people are likely to push you to an end.

The more I think about this, the more I agree. It's a very unfortunate situation, but you have to stand up for yourself and your rights. If you can make an ethical shot on the dog, you should probably take it. Then drive to the nearest river and throw it in. It's not the dog's fault, but it's not yours either.
Be prepared to shoot a maniac, but only do it if it is your absolute last resort, and you have no other options to protect yourself. You need to be able to sleep at night, and you need to be on the right side of the law, WITH EVIDENCE. So keep those cameras covering everything they need to.
My plan tomorrow is to have the judge reverse the TPO and make it them who are subject to it. I am feeling good about it, they are claiming some things happened that are physical impossibilities and I have the pictures to prove it. The dumb SOB stated in writing that I pulled the gun because "he was scared." Oops.
Thank you, they are doing their jobs very well. I am a part of this community in a multitude of ways and I think I will be treated fairly.
