Hunting headaches part 2

I've had a Ladder Stand in this tree since 2003 , facing out into my field. I noticed yesterday the guy with permission to hunt the land next to me put his climbing stand (that he leaves out all year) in a tree 28 1/2 yards away from my stand , I could turn to my right and be looking right at him. Yes I know there is nothing Illegal , you can put your stand wherever you want....However what ever happened to common courtesy ? . Would anyone else set up that close to an existing stand ? I wouldn't even dream of it....He knows I use my stand, he saw me in it last year.

Just like people on a 3000A lake, there could be 2 boats on the whole thing and you know the jackwagon is gunna troll right past you at some point.

I have a similar situation where a guy near me has no less than a dozen stands (that I know of), a lot end up being right in places where I go with my climber. It's almost as if he is hunting me, learning where I go and then setting up a spot.

The difference - I've spoken to him. He told me that he gets too restless sitting in one place too long. He likes to have stands to walk to as he hunts. He sits them for a little while and then moves on. He offered to me, if I wanted, to sit in or use them. He also mentioned that if I was in a spot he would just move on.

Serious question... is it out of sight? Not by you at all? I’ve been asked by neighbors to not actually hunt parts of my own property because they had a stand on the fence line. Even if the guy has permission... he still has a right to hunt his property how he wants too. He’s also cut off from you too. So it goes both ways if he sits there. Maybe have a conversation with the guy and see if he has reasoning and you guys can work something out. It’s a gut punch for sure but think of ways to design the property to put him at a disadvantage and tip the scales better in your favor.
 
Make sure you mark the property line with no trespass signs. Then hang a wind chime on your stand while you are not there. Then put a camera up high looking down the property line towards your stand. Guaranteed he won't be able to resist getting out of his stand to investigate the noise, may even climb your stand. When he does you will have pics of him trespassing going past the signs. Go to your neighbor and let him know you would prefer he address' this issue rather than the police.
 
I guess I am very glad I have the kind neighbors I do.

Respectable decent folks, they talk to me if they have an issue with my fireworks or whatever crazy stuff I am up to.

A blessing to live next to,.. after reading this thread it reminds me of how down right awful some folks can be.

My uncle owned about 2500 river bottom acres, and he doesnt hunt. He has a couple other nephews that would gun hunt it every once in awhile, but more like 1 day out of 5 years. Anyhow I asked him if I could bow hunt it, and he said sure, and I asked him if anyone else has permission, and he said no one has asked him in the last 15 years. He told me he knows a few neighbors are hunting it, but have never asked him, so if I see them, to kick them out, or send them to him, and he will kick them out. Well I found a nice area, a small 10 acre old apple orchard in between 2 ravines, it was way off the road, and back into the property a ways from any direction. I was bow hunting it, and 1 of the neighbors came walking through, I walked over and talked to him, and said my uncle owns this land, and I am the only one with permission, but if he wanted to hunt, to find a different area, because I have posted this area, and planted a food plot. I told him if he had a problem with that to see my uncle. He never talked to him, and I bow hunted during gun season, and there he was. This was the 1st year. After about 5 years of the same thing, I called the game warden, and he wrote him a ticket. The second weekend of gun season, there he was again. I called the warden again. He got another ticket. The next year he had cut down my treestand with a chainsaw, so I called my uncle, and we went to his house, my uncle told him he was also going to press charges, and I was going to charge him for destruction of property. I had pictures of him walking through with a chainsaw. Guess who tresspassed again during the gun season? This time I was gun hunting. I walked over to his stand, which he set up about 50 yards from mine, and asked him if it bothered him that I can see him in my scope, I told him, because it should! Well, he called the warden on me, and the warden wrote him another ticket, not me.

After 10 years of me hunting it, and posting it, and him getting at least 5 trespassing tickets, I gave up. Of the 2500 acres my uncle owned, I was trying to hunt 10 of them, and I didnt bother kicking anyone else off, or even going into the rest of the land. I even offered this trespasser to find a spot somewhere other then this little 10 acre area, and he wouldnt. I stopped hunting my uncles land, and a couple years later, my uncle died. The land got sold in an auction, and a guy I know bought it, and I told him about the neighbor, and asked if he was still having issues with him, he never knew about the small orchard, and went and checked it out, and there he was during gun season again. My friend had called 2 times and charded him with trespassing, and he gave up, and said it isnt worth wrecking his gun hunt, to go mess with this dumbass. So I guess the moral of the story, if you are a criminal, be persistent, you will get your way!

Funny thing is he saw me in this stand last year, he KNOWS I use it. My property is well marked with signs and purple paint , plus a barb wire fence runs the length of the property line. He wanted open permission to be able to track and retrieve anytime...No way I would give that to someone that I don't know or trust , ESPECIALLY after he's had a ground blind 10 feet away from the property line and a ladder stand 15 feet away and directly facing my land, and now the climber 28.5 yds away from my stand . I can't prove it , but I suspect he would shoot onto my land if given the chance, and I got a blurry trail cam pic of someone last year on my land and I'm 99.9% sure it was him. I told him he needed to come to the house and ask permission if he needs to track and retrieve.. I guess he didn't like that . Maybe setting up right by my stand is his way of getting back at me. If I see anyone in that stand I'll go sit up in mine and stay there till dark if I have too.

Wow amazing story !. How much were his trespassing tickets ?. Seems to me the judge would increase the fine each time or give jail time after 5 violations ! . Where I live if your land is posted and someone is caught Trespassing the fine is UP Too $2500 and/or 12 months in jail. I have no idea what the average trespassing fine is probably more like $50 $75 or $100 for first time offenders I'd guess...not much of a deterrent considering how much it costs to buy your own land, or even lease hunting land.
 
Okay let me stress two things:

I cannot sympathize more at the frustration such actions can trigger in a man. Grew up hunting 9 acres of land, Pops and I did all we could from hing cuttings, plantings and even a few small plots to do best we could to steer travels away from borders because guess what despite having less land than some of the neighbors they knew the deer preferred our place and while there literally were only 5 neighbors with parcels that touched ours, firearms season opener saw 5 hunters within 40 yards to as close as 5 yards from our line.....PISSED ME OFF! A lot of sweat equity went into our piece and our plans and our strategies when was best to hunt and what not. We suspected line shooting and recovery without asking....but never could prove it. Then one year a neighbor made a fatal error...pops was hunting on the ground, very rare and witness the neighbor shoot a buck (fork horn) on our property, access without permission and drag it back without permission. Pops just sat in disbelief at the gall but never said anything because this was the father of the neighbor guy that was very nice and up until then allowed us to have a stand we had before he even moved there on the corner of his corner.

Well that year, we tore that stand down, and hinge cut the entire border to our north edge where they were, posted more signs and essentially made it tough for a deer to even travel through majority of the trail. Neighbor guy calls and Pops expressed what happened and why we are done. That father NEVER once even after his son apologized to my father still to this day has admitted any wrong doing. My parents just sold this past year so no longer an issue but I saw all this because trust me I get it.


HOWEVER....

Being a property land owner myself, if I own 22 acres of land, I should be able to set up on any piece of that 22 acres. You don't own any of it, it is mine. Now would I sit up facing a stand over a line, to a property I don't have permission to shoot to NO. Shoot I would even contact landowner and explain why the stand is going to be facing down the line (left hand bow shots much easier) and commit to NO shots will ever be considered to the right.

This guy in your story has done nothing wrong, simply hunts close to the line and is suspicious with some spots and how he faces hunting them. Instead of assuming the worst of him, I'd reach out to him. Tell him you got a picture of someone walking your place last year, even tell him the time roughly and ask him man to man if it was him?

Until you actually know a law is being broken you are only going to hurt your relationship and your hunting experience worrying about what a neighbor may or may not be doing. I just Saturday discovered a guy is hunting 20 yards from my line, his woods touches corner to corner to mine and overlooks the overgrowth field property to my E, his S...I suspect with all I'm worth that he will shoot into that fallow land...however I even told him I run cams, I'm out here a lot and I know I'm the only one with permission to walk and recover off that land as of now, but offered to try and get him in touch with the landowner for the same priviledge (the guy does not allow hunting) - but told him I promised the landowner to report ANY one shooting onto or while on that land. Message is sent, yet I stayed very polite - attempted to help him find blood on a shot he took and in the end found out he shot a target buck last year I had tons of camera pictures of. That night I texted him a few of the best, and he was very appreciative. I am hoping if he understands the character of the man he knows is out there could be watching, it may cause him to abide by the laws even more so....and I pray for his sake it does, as I have NO patience if not.

You are 100 % correct he has a right to hunt the property how he want's too. However you are asking what I consider common courtesy. I can only speak on what I would do....No matter if I just bought my own land or gained permission to hunt some land , when walking it and looking for stand locations , it's just common sense and decency in my mind not to set up right in view from another hunters existing stand , where with a turn of a head you'll be looking right at each other lol.

Not gonna lie, making friends with the landowner is HUGE. Honestly it forces a better relationship if nothing else with the hunters....or it strains theirs and it eventually ruins their ability to hunt it. I've picked up two spots in my life because of this.

I can only speak on what I would do....No matter if I just bought my own land or gained permission to hunt some land , when walking it and looking for stand locations , it's just common sense and decency in my mind not to set up right in view from another hunters existing stand , where with a turn of a head you'll be looking right at each other lol.

That would be a waste of gaining permission or buying a piece of land then. If the back corner shows an amazing shelf or saddle that happens to be in the corner of my land, I'm sitting up on it NO MATTER what when conditions are right. I don't care if a guy is set up 2 feet from me behind my tree and across the line. Least I know I'll be there to keep him honest and shoot anything on my side.

The actual landowners are elderly and one has dementia...sad to say but they both really don't know what's going on, so really no point in talking to them unless I catch the guy or his friends trespassing or shooting onto my land. My stand has been there since 2003 and that stand or another one will be there as long as I own the land. In 20 years there have been four owners of the adjoining land...sooner or later there will probably be a new owner...things could bet better or worse, only time will tell

The kid that hunts there has the wool pulled over their eyes and brings everybody and their mother in to hunt over there , and I'm not sure if they are aware of it. Another guy has had permission to hunt there 7 years , and is very respectful and has done work on their land to help them out. This new kid been there 3-4 years comes along and tries to tell the other guy what days he can hunt and what stands he can hunt out of , like he owns/runs the place. The kid even wanted me to coordinate with him when I'd be hunting in my stands on my land....that he set up close too. I told him to take a hike

Correct , I know there are no laws stating how close a stand can be to an adjoining property , and I never said anything to him about it when he placed them there, because there is nothing you can do about it (unless I catch him shooting onto my land) . This Kid is not a neighbor, just someone that has permission to hunt the land next to me. The ladder stand 15 feet away and ground blind 10 feet away from the property line were one thing, but setting up 28.5 yards from another Mans existing stand ? that's BS as far as I'm concerned.

Actually the first and only time I talked to this Kid was in September. He was hanging a stand 50-60 yards from the same ladder stand of mine in the picture (so he has two stands near it now) , and he called me over wanting to exchange phone numbers so we can "coordinate" when we would be hunting them. I told him No I wasn't getting involved with that, I'm not checking with anyone when I hunt my own land, and he didn't seem to like that, he also asked if he could have permission to track and retrieve game on my land...again I said NO, I said if you need to track and retrieve you need to ask permission at my house....If I'm not home someone there will contact me. I did mention at that time I had a blurry picture of someone on my land....but he never owned up if it was him or not. I am under no obligation to give anyone open permission to track and retrieve on my land , especially after he sets up that close to the line , what would stop him from shooting on my land and then just say he tracked it there ?.

You can say what you want about my suspecting and worrying But like Judge Judy says " if it walks like a duck and quacks like a duck...it's a duck" so most likely my gut instinct is correct. Just like the time I caught two guys hunting on my land , I gave them a warning , showed them the property line, and I could tell they could care less and would be back. I got up early the next morning well before it got light and headed back by the property line. Sure enough as soon as it got light they were both walking down the 3 arcres one of them owns headed towards my land......except I made the mistake of having blaze orange on and when they got near the property line they saw me, turned around and went back to the house.
 
Where's the property line in that pic? Is he trying to shoot deer before they get into your field?
