Garden Weed ID?

ND Peter has got this growing in his garden and asked me what it was. I'm not sure what this could be. He's gardening in the city of Fargo, ND.

I think nightshade is in the same family as tomatoes.

3 to 5 berries can kill a small child(and they are somewhat sweet). 1 leaf can kill most adults. The root contains the highest concentration of toxins. Not good.
